| 摘 要： | 随着我国民主与法治进程的发展,公众参与意识的不断增强,公共政策的合法性问题成为人们不可回避的根本性问题。公共政策的合法性问题关系到公共政策能否以及为什么应该获得其成员的忠诚问题,公共政策只有具备合法性才能够得到公众的广泛认可和执行。对于转型期的我国来说,要有效消解公共政策的主体合法性危机、程序合法性危机、价值合法性危机,则必须重视以公众参与为主体的网络公共领域的建构和发展,有效地保障公共政策的公平、正义,代表公共利益的价值得以实现,为公共政策提供了主体、程序及价值合法性。

| Abstract: | With the development of China's democracy and the rule of law and awareness of public participation gradually enhanced,the legitimacy of public policy becomes the fundamental issues that can not be avoided.The legitimacy of public policy is concerned with whether public policy can gain its members' loyalty and why they should be loyal to it.Only when public policy acquires the legitimacy can it get the public's universal recognition and implementation.Our country is in the transitional period;in order to effectively remove the main crisis of legitimacy of public policy,procedure crisis,value legitimacy crisis,we must attach importance to the construction and development of the network public sphere with public participation as its main part and effectively protect public policy's fairness,justice and the realization of the value representing public interests and provide the main part,procedures and the value legitimacy for public policy. |
