| 摘 要： | 《春秋》治狱是董仲舒重要的实践活动，也是他《春秋公羊》学在现实政治生活中的运用。他治狱的最高原则就是“原其志”，即以主观动机为判定罪行的根据。董仲舒对具体案例的判决，却体现了温和与宽容的精神。“原心定罪”很快就成为西汉司法实践的原则，形成了以《春秋公羊传》断狱的风气，在涉及重大政治案件时，其决断具有相当的严酷性，在君主专制时代影响深远。

| Abstract: | Chunqiu trying of cases is Dong Zhongshu＇ s important practice, and also an application of his Chunqiu Gongyang in real political life. The highest principle of Dong＇ s trying of cases is ＂trace the original motivation＂. Dong＇ s actual adjudications, however, reflected the ＂modest and tolerant＂ spirit. Quickly, the Chunqiu Gongyang style of trying cases spread during the West Han period. |
