摘    要:《劳动合同法实施条例》第十七条充分体现了保护用人单位培训利益的立法思路,能激发用人单位对劳动者在职教育的积极性。十七条有关培训服务期的规定在实践中有可能被用于“规避”订立二次固定合同,由于此“规进”行为必须通过对劳动者规范的培训来实现。将促使用人单位加大对培训的投入。并通过续延服务期稳定劳动关系,实现劳动关系双方的共赢。《劳动合同法实施条例》及相关法律能够约束用人单位随意约定培训服务期的行为。

Abstract:Article 17 of the Regulation on the fully shows the legislative thought of protecting provide in-service education for employee. Article Implementation of the Employment Contract Law, which employer's training interest, can motivate employer to 17 about period of training service maybe used to avoid concluding second fixed-term contract in practice. Since this kind of avoid must be implemented through training employee, employer will be pushed to increase the inputs in in-service training, besides win-win situation between both labor relation sides will achieve by extending service period and stabilizing labor relation. Moreover, the Regulation on the Implementation of the Employment Contract Law and relevant regulations can constrain this behavior which training service period is appointed at employer's option.
