| 摘 要： | 随着公司法人的迅速发展，股权继承问题日益突现。但是，由于我国现行立法的缺陷，使之解决起来无法可依。股权作为一种财产性权益应当能够继承，继承人可以继承股权成为公司股东。各继承人对继承股权的分割应当根据公司性质区别对待。为适应时代需要和公正执法，建议完善我国相关立法，建立适合我国国情的股权继承法律制度。

| Abstract: | With the rapid increase of the corporation representatives ,s ome issues on the succession have emerged,but we don't have any law to consult w hen dealing with them because of the inadequacy of the current legislation Stock rights could be inherited as a right of property and the heirs thus become the stockholders.And the portion of succession should be determined according to the company itself .To keep up with the times and ensure the justice of administrat ion,relevant legislation should be perfected and an appropriate legal system be established for the succession of stock right. |
