| 摘 要： | 环境权的提出，是当代法律对社会现实生活的积极回应，是人性尊严和人权保障之理念在当今环保时代的具体体现。从环境权确立的必要性上来看，环境权应该获得宪法化，只是入宪的途径存在差异。由于环境权的特性，现在还是应以非环境权的形式入宪，即除了在宪法中确立一个基本环境权之外，应该用尽现有宪法资源，将环境权的内涵纳进现有权利的体系即可。

| Abstract: | The proposition of environmental rights is the positive response of law to the contemporary social reality, and is the reflection of the concept of human rights and human dignity in today＇s environmental protection era. From the necessity of establishing the environmental rights, we should bring the environmental rights into constitution, but the ways to entering the constitution are different. Due to the characteristics of the environmental rights, now we should adopt the form of nonenvironmental rights into the constitution, that is, in addition to establishing a basic environmental rights in the constitution, the constitution should be exhausted existing resources, bring the connotation of the environment rights into the existing rights system. |
