| 摘 要： | 全民健身地方立法是我国全民健身工程有序推进的重要保障。采用文献资料、对比分析等研究方法，对全民健身地方立法存在的问题及原因、全民健身地方立法质量提升进行研究。研究认为全民健身地方立法应该特别重视立法重复及法律责任模糊或缺失问题，造成这种问题的原因包括全民健身义务主体单一、立法技术技巧不完善、经费缺乏及地方利益本位等原因。据此，从法律关系主体多元化、立法内容强化地方特色、立法技术技巧规范化、立法效果强调可操作性等4个方面提出了全民健身地方立法从"有"转"优"的具体策略。

| Abstract: | Local legislation on national fitness is an important guarantee for the orderly advancement of national fitness project in China. The problems and reasons of local legislation for national fitness were analyzed by using literature study, comparative analysis, language analysis and other research methods. The research showed that the local legislation of national fitness should pay special attention to the duplication of legislation and the ambiguity or absence of legal responsibility. The causes of this problem included that the subject of the national fitness obligation was single. The legislative techniques were imperfect. The funds were not sufficient. This paper put forward strategies of perfecting the local legislation of national fitness so that the main body of legal relation could be diversified, the local characteristics could be established, the technical technique of legislation was standardized, and the effect of legislation emphasized the maneuverability. |
