| 摘 要： | 航空、银行、石油、电信等行业的大型国有上市公司．纷纷在新劳动合同法实施前突击把一些老员工改为劳务派遣，大批中小型企业竞相效仿。劳务派遣，这个本以为要被新劳动合同法打入冷宫的行业却意外地因为这部法而繁荣起来，成为众多企业集体规避新法责任的缺口。如何完善劳务派遣的法律框架，已成为当下的紧迫任务。
