摘    要:在研究生教学中,国际法学课程的学习和研究应该密切结合国际社会的国际法实践。缺乏与国际法实践的联系,学生往往对国际法的法律性存有疑虑,并对国际法在旧际社会中的实际效用和权威性产生质疑。法律实证研究主张以事实学的方法研究法律规范,解释法律规范的制定和法律规范适用的实际效果。法律实证研究不仅对学生是一种有效的学术训练,而且更适宜于培养能够满足实际需要的具有“国际法思维”的应用型人才。当然,法律实证研究并不排除传统法学的思辨研究。

Abstract:Graduate-level study of international law should be integrated closely with the practical application of international law in the world community, a lack of which will create doubts in students about the actual effect and authority of international law. The empirical method for legal research proposes fact-based studies and interpretations of legal norms, their adoptions and actual effects. Empirical research not only provides effective academic training for students but also fosters legal professionals who will have international thinking and meet practical needs. In addition, empirical research does not exclude theoretical research in traditional legal study.
