| 摘 要： | 道德过错被害人由于先前行为的道德责难性,受到不法侵害后,其权利救济陷入了困境。这主要表现为:一是自力救济的正义动机和正当手段的缺失;二是社会救助的道义支持、法律援助和物质救助的缺乏;三是公力救济的公权理性、法律效果和个人权利的缺位。
