| 摘 要： | 土地征收中的公益性问题并不仅仅局限于目的的公益性。土地征收法律关系中的公益性问题往往被忽视，然而这一问题恰恰是我国土地征收中诸多弊病的症结所在。本次修宪无疑将对科学合理解决目前土地征收中存在的问题提供了最高法律依据，也对土地征收的研究提供了契机。

| Abstract: | Public welfare properties of takingover of land are beyond those of purpose. The issue of public welfare properties in legal relationship about takingover of land is usually neglected. However, it is the origin of many drawbacks of takingover of land. The newly-revised constitution provides scientific and reasonable solutions to the existing problems of takingover of land with supreme legal basis. Meanwhile, revising constitution is the turning point of the research on takingover of land. |
