| 摘 要： | 司法实践中,经常出现针对为阻止犯罪结果发生而作出真挚努力但未能实现阻止犯罪结果发生之情形,在不能适用中止规定情况下,日本学者首次提出了"共犯关系脱离"的概念。对此,本人从剖析"共犯关系脱离"之机能出发,分析国内外目前的研究现状,提出成立"共犯关系脱离"需满足的条件,并分别从教唆犯、帮助犯、共同正犯具体展开分析。

| Abstract: | In judicial practice,it often appears to stop crime occurs and make sincere efforts but failed to achieve prevent crime occurred as a result of not applying the suspension,in defined circumstances,the Japanese scholar first put forward the concept of "complicity from relationship of joint crimes ".In this regard,the paper starts from the analysis of" complicity from relationship of joint crimes ",to analyze current research situation of the domestic and international,put forward the conditions to establish" complicity from relationship of joint crimes",and from the instigator,helper,joint criminal to make specific analysis. |
