| 摘 要： | 最新审议通过之《物权法》虽肯定了悬赏寻找遗失物的合法性与合理性，但仍旧未赋予拾得人报酬请求权与附条件先占取得权，并仍规定无人认领的遗失物归国家所有，此举违背民法的市民法与权利法的本质以及权利义务均衡原则，有必要加以修正和完善。
