| 摘 要： | 生育权是已达法定婚龄的男女决定是否生育和选择如何生育的人格权。首先，生育权是人格权而不是身份权；其次，生育权只有达到法定婚龄的人才能享有；最后，生育权的内容是决定是否生育和选择如何生育。凡达到法定婚龄的人都有生育权但不得超越计划生育的限制，为此，应当确立完善的制度体系。

| Abstract: | Procreation right is one of personality right of man and woman of over legal marry-age. First, procreation right is one of personalit y rights and not of status rights; secondly, no one but over legal marry-age can t ake procreation right; finally, the content of procreation right is to decide wh ether or not to procreate and how to procreate. Every one of over legal marry-ag e can take procreation right but not extand the limit of planned parenthood, so, we must establish perfect system to deal with the relative issue. |
