| Abstract: | Constant expansion of administrative discretion right and constant strengthening of its control constitute a main thread in the development of modern administrative law. The principle of reasonableness and the principle of proportionality are basic principles to exercise effective control of administrative discretion right, developed in common law system and civil law system respectively. They cause administrative law to develop from formal rule by law to substantial rule by law. |
