| 摘 要： | 公民基本权利地位的宪法建构是当代中国相当长一段时间中必须正面直视的一个风标,关系到宪政社会路径的选择和契机。从整体上看,公民基本权利是宪法的灵魂和内核;从其内容和结构上看,公民基本权利分为显性条款和隐性条款;从范式对称的角度看,基本权利与基本义务的关系蕴涵丰富的辩证法色彩;从现实的角度看,依法治国首先是依宪治国,依宪治国首先是保障公民基本权利。

| Abstract: | The constitutional establishment of the fundamental civil rights position is a weathercock contemporary China must face in a relatively long period of time,and it has a direct bearing on the selection and opportunity of constitutional government social route.From overall perspective,fundamental civil rights represent the soul and core of the constitution.In terms of content and structure,fundamental civil rights can be divided into dominant articles and recessive articles.In terms of paradigm symmetry,the relationship of fundamental civil rights and duties contains rich dialectics flavor.From practical viewpoint,managing state affairs according to law firstly means managing state affairs according to constitution,whose top priority is ensuring fundamental civil rights. |
