| 摘 要： | "直接适用的法"是指特定的涉及国家基本利益的强制性规定,可以不经冲突规范的指引直接适用于涉外民事关系。《中华人民共和国涉外民事法律适用法》第4条首次针对"直接适用的法"予以规定,在立法层面上对完善我国的国际私法体系具有重要意义。但是对于该条的理解因为理论和实践方面的原因仍存在着模糊和不完备之处,因此,对于强制性规定的概念和类型,第4条和公共秩序之间的适用层级,以及如何在实践中更好地运用"直接适用的法"这一原则等问题,都是实务界与理论界值得关注的问题。

| Abstract: | "Rules of immediate application" are those special forceful regulations concerning with country’s profit,and the fourth article of "Law of the Application of Law for Foreign-related Civil Relations of the People’s Republic of China" has defined it for the first time.On the basic of article fourth,"rules of immediate application",mandatory provisions,foreign-related mandatory provisions are analyzed gradually,the foreign-related mandatory provisions are categorized into two parts and the application of hierarchy among "rules of immediate application" and reservation of public policy is discussed. |
