| 摘 要： | 回避制度是民事诉讼中的一项重要制度，以保证民事案件得到公正的审判。2013年1月1日施行的《民事诉讼法》中涉及回避制度作出了一定的修改。在审判实践中，我们不难发现回避制度实际操作仍有着诸多缺陷，尽快完善相应的配套规定与研究，不断发挥回避制度的优越性具有重大意义。

| Abstract: | Challenge system is important in the civil action, which can guarantee civil cases to be trialed fairly. ＂ Civil Procedure Law＂ which will come into effect on January 1, 2013, makes certain modifications on challenge system. In the trial practice, it can easily be found that this system still has many defects in practice. It is of great significance to improve the matching regulations and research as soon as possible, and give its advantage to a full play constantly. |
