| 摘 要： | 域外代孕立法可分为禁止、调控、混合与静态四种模式。无偿的完全代孕合同或无偿代孕合同应成为允许代孕的立法例的当然之选。我国未来立法应承认一定条件下无偿的完全代孕合同的合法性。

| Abstract: | Surrogacy legislations in foreign countries can be divided into four models: prohibition,regulation,compound and static approach.The contract of free surrogate motherhood should be the first choice in the legislation of permitting such phenomena.The free motherhood should be permitted legally under certain condition. |
