| 摘 要： | 《刑事诉讼法》修正案以及《精神卫生法》的出台使我国精神病患者强制医疗制度有了质的进步。然而,由于立法与司法实践的脱节以及不同法律文本之间规定的冲突和矛盾,我国强制医疗制度仍存在诸多问题。譬如,在实体上,强制医疗制度存在着性质尚不明确、适用对象范围过窄、公安机关采取的临时保护性约束措施缺乏具体的程序规定、以及检察机关的监督方式缺乏规定等不足之处;在程序上,强制医疗制度存在着强制医疗程序与已启动的刑事诉讼程序的关系衔接不明、审判程序不明确以及强制医疗的期间缺乏规定等缺陷。为了更好的保障该制度的实施,有必要从程序和实体这两个方面进一步完善我国的强制医疗制度。

| Abstract: | With the Promulgated of Criminal Procedure law amendment and Mental Health Law,Chinese psychiatric patients mandatory medical system has been a qualitative leap. However,due to disjointed between legislation and the judicial practice,conflicts and contradictions in the legislative text,the mandatory medical system still exists many problems. For example,it has unclear nature,the range of suitable object is too narrow,the temporary protective measures taken by polices lack of specific procedural requirements and other defects in the substance; it also has a is a relationships convergence unknown between initiated criminal proceedings and compulsory medical procedures,the unclear of trial proceedings,the lack of regulations of the period of mandatory medical system in the procedural. In order to better safeguard the implementation of the system,it is necessary to further improve Chinese compulsory medical system from the procedural and substantive aspects. |
