| 摘 要： | 现行公立高校的事业单位法人的法律定位不合理,公立高校承担的法律主体角色呈现出复杂化状态,严重制约了高校的健康发展。直接由立法机关以单行法规独立规范公立高校的法律地位,在大学与政府平行分权的基础上,确立公立高校独立于行政机关的公法人之特别法人的法律地位,可以提供完整的、对大学主体人群的权益保障,从而确保大学自治的实现。

| Abstract: | The definition of the existing public university＇s institution corporation legal status is unreasonable. The legal subject role of the public university presents a complicated and it＇s legal status is in a confused state, which has severely restricted the sound development of colleges and universities. The public university＇s legal state should be independently standardized through enacting specific regulations by the legislature. Moreover, from the angle that the university and government have the concurrent right in law, we should establish the public university＇s legal status as a special legal person of the public legal person, so as to ensure the realization of the university＇s autonomy in law and provide the main body of university with complete rights and interests guarantee. |
