| 摘 要： | 奥林匹克标志作为人类文明的精神符号,具有不可侵犯和亵渎的意义。但在当代商品经济意识不断膨胀的作用下,最为神圣的精神成果也受到了侵扰和腐蚀。如何以立法形式保护人类文明的精神成果已引起世界各国的高度重视。从借鉴美、澳、英3国奥林匹克标志侵权法律规制的经验性成果与我国"以法护标"系列举措的对比性研究出发,总结保护奥林匹克标志在立法领域的成功经验。在此基础上提出完善立法形式,扩大保护范围,明确使用范围,采用高效救济途径等建议,来完善我国奥林匹克标志侵权立法,以期对奥林匹克标志的全面保护提供借鉴。
