| 摘 要： | 业主委员会是随着我国城镇住宅区建设的迅猛发展而出现的新生事物。在物业管理纠纷中,业主委员会是否具有诉讼主体资格存有争议。基于业主委员会的实体法的法律地位,文章突破传统的民事诉讼理论,从业主委员会存在的现实合理性和现代诉权理论出发人为应赋予业主委员会诉讼主体地位。

| Abstract: | The owner committees came into being as the rapid development of real estate in urban China.Today,there is still no consensus on whether the owner committees are entitled subjects of litigation.This paper breaks through the traditional civil litigation theories on the basis of the status of the owner committees in the substantive law and points out that the owner committees should be entitled the principal status in litigation because of the realistic rationality existing of owner's committee and the modern civil litigation rights theories. |
