| 摘 要： | 政府信息公开法所倡导的基本原则是:信息公开是原则,不公开是例外。在我国当前的政府信息立法中,需要界定国家秘密的范围。在政府信息公开与保密之间寻找一个平衡点,既要保障国家的安全与利益不受损害,但又要适应社会发展趋势保障公民的知情权,尤其是防止行政机关借口国家秘密损害公民的知情权。

| Abstract: | The basic principle of the law of opening governmental information is that: to open the information is the principle and not to open is the exception.In the governmental information legislation in modern China,we need to define the scope of the national secrecy.We should seeks one balance point between the openness and the secrecy,we should safeguard national security that can not be harmed,and we should also safeguard citizens "right to know" so as to adapt social development tendency.Particularly we should prevent that the administrative organ harms the citizens' "right to know" by the excuse of keeping country's secret. |
