| 摘 要： | 破产管理人在破产程序中负责破产财产的管理、处分以及执行等事务,处于核心地位。我国《企业破产法》引入了破产管理人制度,但司法实践中,破产管理人在选任制度上遇到了很多难题。破产管理人在选任主体方面要建立"三元"化选任模式,赋予债权人、债务人意见权,在选任范围方面要逐渐减少行政干预,引入破产管理人资质考核制度等。

| Abstract: | The new Enterprise Bankruptcy Law has introduced a bankruptcy administrator system, but there＇ s a big problem about the selection of the bankruptcy administrator during the juridical practice. This paper proposes that we set up three selection modes for selecting the subject, giving the creditor and the debt- or the right opinion. As for the selection of range, the bankruptcy administrator should decrease the adminis- trative intervention gradually, and introduce the bankruptcy administrator＇s appraisal system and so on. |
