| 摘 要： | 民间非物质文化成果作为一种特殊的创造性智力劳动成果,理应纳入知识产权保护范畴,但目前在我国有关知识产权保护的法律制度中尚缺乏对其进行保护的相关规定,使一些优秀的民间非物质文化因缺乏有力的法律保护而遭到了不适当的开发,许多独有的民间非物质文化遗产流失国外等等。因此,对民间非物质文化知识产权进行保护已是刻不容缓。本文着重对民间非物质文化知识产权的权利主体、权利性质以及独创性问题进行了思考,并对民间非物质文化知识产权保护的立法提了几点建议。

| Abstract: | The folk non-matter culture achievement,as one kind of special creative intelligence work achievement,should be protected by the intellectual property rights.But at present,because of lack of related regulations in our country,some outstanding folk non-matter cultures were unsuitably developed without the powerful legal protection,and many peculiar possessions of the folk non-matter cultural heritage drained overseas,etc.Therefore,it's urgent to carry out some programs to protect the property rights of the folk non-matter culture.The problems of the subject of object,the nature of the rights,as well as the original question are discussed,and then several suggestions are made to establish some protection legislations about the intellectual property rights of the folk non-matter culture. |
