| 摘 要： | 刑事被害人国家补偿制度对被害人而言是一种恢复性的刑事保护制度，从实质上来看是一种社会救济方式，且应以刑事诉讼的存在为前提。建立有中国特色的刑事被害人国家补偿制度应主要考虑补偿的方式、补偿对象和条件、补偿基金来源、申请补偿期间及主管机关等问题。

| Abstract: | National indemnity system for penal victims is a rehabilitative penal protective system,which in fact,is a sort of social relief,and should take the criminal action as a preexisting.In the construction of national indemnity system penal victims of Chinese characteristics,the mode,subjects,conditions of compensation,the resource of compensation fund,the period during compensation application and the authority-in-charge should be taken into consideration. |
