| 摘 要： | 事实重婚现象在我国已经成为比较严重的社会问题,但由于我国立法对事实重婚现象没有明确的规范,使得司法实践中对事实重婚的认定和处理陷入困境.为有效的规范事实重婚行为,应明确事实重婚的定义以及事实重婚的构成要件,合理划分其罪与非罪的界限;建议主要运用民事和刑事手段分类对该行为予以具体处理.

| Abstract: | The phenomenon of factual bigamy in China has become a serious social problem. But because our legislation hasn＇ t clear specification the phenomena of factual bigamy, which judicial practice difficulties in resulted in the identification and treatment of factu- al bigamy. In order to regulate the action effectively, we should define the concept of factual bigamy and different elements of factual bigamy. We should identify the crime with the non - crime of factual bigamy and handle factual bigamy from the civil and criminal measures distimctively. |
