| 摘 要： | 我国村委会数量众多,而村委会的法律地位在法律上无明确而详细的规定,导致实践中遇到诸多法律问题,我国村委会从宪法组织法角度看属于"基层群众性自治组织";从行政法角度看,属于法律法规授权的一类组织;从民法的角度看,不具有法人地位,属于"其他的组织"。在现实中,存在着与基层政权、基层党组织及行政主体与非行政主体的冲突。
