| 摘 要： | 新《婚姻法》增设的离婚损害赔偿制度实施至今已有5年时间,但该制度的运行状况并不尽如人意,原因在于立法对该制度的规定过于疏漏,缺乏可操作性。针对该制度实施过程中凸现的几个问题的完善提出了粗浅意见。
