| 摘 要： | 鉴于我国多年的农村土地承包经营实践存在的缺陷 ,学者提出了土地私有化、永佃权、农地使用权以及保留承包经营权等不同的物权立法模式。这些主张各有特点 ,但笔者以为 ,农地使用权模式应为我国物权立法的选择。

| Abstract: | Considering the protracted deficits in the practice of contracted land in China's countryside, diverse legislative modes of property right have been recommended by scholars, such as privatization of land, eternal right of tenancy, use right of country lands and contract and managing right of land to be reserved. Respectively characteristic as each of the above mentioned modes is, the auther argues that the mode of the use right of farm land should be a legislative option of property right in our country. |
