| 摘 要： | 《二年律令》中同时出现了“内孙”和“外孙”两个概念，基于现代人的成见，我们很自然地以现代汉语中的“外孙”一词为参照去解释“内孙”，把它理解为从儿子所生的父系家族的成员。《二年律令·收律》的一则规定打破了这一思维定式。《收律》关于“收”的例外规定中有“内孙勿为夫收”，即具备“内孙”身份的人，则不因父亲（即该丈夫）的犯罪行为而被收。“内孙”与“外孙”，作为“子”所生的隔代晚辈直系血亲，不是以“子”的性别为依据来划分的，而是从家系的传承，即在家族中的地位来区分的。已婚女子所生的、留在自己父家族的孩子，也是“内孙”。内、外孙的划分，表明汉初婚姻家庭形态的复杂性。
