| 摘 要： | 从法律的角度,对学校和学生是什么关系,证明过错的举证责任是谁,如果学校和学生都没有过错怎么办,是否适应公平责任原则进行探讨,认为：《民法通则》和《学生伤害事故处理办法》在处理学校体育伤害事故时,出现了学生和学校关系不明确,举证不合理,公平原则无根据现象。建议：进一步完善学校体育中的法律条款。

| Abstract: | By using the methods of literature and logical analysis,and being in the perspective of civil liabilities,the author researched on what relationship between school and students was,who supposed to assume the burden of proof was once involving liabilities for a tort occur,and what the principles of equality were.The article shows that there are many problems in dealing with students＇injuries according to current civil law and regulations on dealing with students＇injuries,such as no clear relationship between school and students,unfair burden of proof involved,and no concrete basis on fair burden of proof,and puts forward some advices to make the clauses concerning school sports more perfect and more reasonable. |
