| 摘 要： | 为正确处理物流经营人之独立型履行辅助人对物流服务合同当事人的法律责任问题,对我国现行法律规定、国家标准、相关格式合同和标准交易条件进行分析,得出如下结论:独立型履行辅助人按照与物流经营人之间的货物运输合同、仓储合同、承揽合同等典型合同向物流经营人承担违约责任有法律依据;独立型履行辅助人与物流经营人一起向物流委托人承担由于货物的灭失、损坏或不正确交付而产生的连带责任,而不单独承担侵权责任,符合公平原则及交易安全原则。

| Abstract: | To correctly identify the liability of the logistics operator’s independent performing assistant to parties to the logistics service contract,Chinese laws,national standards,adhesion contracts,and standard trading conditions are studied empirically.Conclusions then come that:the independent performing assistants shall perform obligations to the logistics operator under the contract of carriage,warehousing contract,or processing contract;it can comply with the rule of fairness and the safe dealing principle that the independent performing assistants assume liability together with the logistics operator for loss of or damage to or incorrect delivery of goods to the logistics entrustor jointly and severally,but not bear liability for tort. |
