| 摘 要： | 法官的刑事自由裁量权受法官的思想素质、道德水准、业务水平、个人见解、生活经历等个人元素的影响和制约,当然具有主观性,常常集褒贬于一身.因此,探讨刑事法官如何正确评价认识并合理运用自由裁量权,对完善刑事司法,实现法治追求的公正公平要旨具有极其重要的意义.
