| 摘 要： | 论证了建立中国体育仲裁制度的必要性和现实性,认为中国体育仲裁制度是一种特殊类型的仲裁,具有自身的特点和基本属性,它既不同于<仲裁法>之仲裁,也有别于劳动仲裁.在体育纠纷裁决机制中,它应处于核心位置,是一些体育纠纷裁决的诉前必经程序.根据其纠纷争执标的法律属性,中国体育仲裁裁决分为可诉性和终局性两类.

| Abstract: | The paper discusses the realistic significance about establishing sports arbitration system in China.The author considers that sports arbitration system is of its own characteristic and basic attribute which is different from the arbitration of Arbitration Law or labor arbitration.Among all the adjudication mechanisms to resolve sports-related disputes,sports arbitration system plays a crucial role and is also an inevitable procedure before suing for settlement of some sports disputes.According to the legal nature of disputes related to sports,Chinese sports arbitration can be divided into two types: lawsuits and final award. |
