| 摘 要： | 摘要：为完善我国体育赛事产业法律规制，实现依法治体，在充分把握我国体育赛事产业化法律规制变迁的基础上，采用文献资料法、专家访谈法和案例研究法，对体育赛事产业化实践中存在的法律规制供给失灵现象进行探讨，结果表明：赛事产业权利保障法的缺失性与相关法律规制保障的局限性；赛事产业政策内容宏观，操作性不强；体育行政执法迷失与赛事产业执法主体缺位等问题，是体育赛事产业化法律规制面临的主要问题。针对这些问题，提出修订和完善法治，消除赛事产业焦虑与侵权困扰；借鉴西方赛事产业法规，让渡赛事产业链的利润空间；建立赛事产业权益保障联盟，健全赛事产业保障社会机制等对策，对促进体育赛事产业的健康快速发展，具有重要意义。

| Abstract: | Abstract: In order to perfect legal regulation system for sports event industry and realize the law governing sport in China, on the basis of fully grasping the changes of the legal regulation of sports events industrialization in our country, this study discussed the phenomenon of the failure of the supply of legal regulation in the practice of sports events industrialization by using the method of literature, expert interview and case study. Conclusions: The main problems in the legal regulation of sports events industrialization included the lack of the law on the protection of the competition industry and the limitation of the relevant legal regulations, the macro content and poor operability of the competition industry policies, the loss of the sports administrative law enforcement and the absence of the subject of law enforcement in sports event industry. In view of these problems, the following countermeasures were put forward, including the revision and improvement of the rule of law, the elimination of competition industry anxiety and the perplexity of infringement, the profit space of the competition industry chain, the establishment of the competition industry protection alliance, and the improvement of the social security mechanism of the competition industry. This study was of great significance to promote the healthy and rapid development of sports event industry. |
