| 摘 要： | 体育与人权,多元的文化置于文化多元的境地,不禁有了交往并渐呈契合之态。这种契合表达了作为人权之体育的历史必然,也预示了体育法治未来的基本走向。从起源论的视域来看,无论与习俗、宗教、战争如何交织难解,人的需求始终是体育与人权的同一本原;从本体论的视域来看,体育与人权的主体都是具有自然属性和社会属性的人,最终目的都是促进人的全面自由发展,体育与人权的主体共同呈现出普遍性和特殊性、个体性和集体性的双重属性,内容则共同具备空间维度的广性和时间维度的代际性,规则之治成为体育与人权最凸显的外在表征,共同的人性则成为两者最异曲同工的内在超验之维。

| Abstract: | In multicultural society,sports and human rights tend to interpenetrate each other and come into a new consilience.From the point of archology,both sports and human rights come from the basic human demands,no matter how complex the relation between them and custom,religion,and war is.From the view of ontology,sports and human rights have the same purpose to promote the people’s all-round development,and have the same subject which is human with natural attributes and social attributes.At the same time,the subject of sports and human rights owns double attributes,universality and particularity,individuality and communality.The content of sports and human rights is extensive in space and intergenerational between generations.For both sports and human rights,the most characteristic external representation is rule of rules,and the same human nature makes them different in approach to the same way of the same intent. |
