| 摘 要： | 学校体育伤害事故中"学校监护"一直是一个非常棘手的问题,问题的焦点是学校或其他教育机构是否是学生的监护人?对未成年人的生命安全和身体健康负责,不让他们的权益受到侵犯,是监护人的义务.监护本身是一种权利和义务的结合体,法定的监护人并不因为学生到了学校而突然发生转移.对学校体育伤害事故予以体现相应的公平原则和道义补偿,公平原则下的赔偿是法院可以判决的,而道义上的补偿,学校是可以拒绝的.

| Abstract: | School guardianship is all the time a hard nut to crack in the accidents of sport injuries at schools. The focus of the issue is whether the schools or other educational institutions are the guardians of students. It's the guardian's obligation to be responsible for teenagers' life safety and health and protect their rights and interests from being infringed. Guardianship itself is a combination of right and obligation. Legal guardianship can't be shifted just because students move to the schools. The principle of fairness and moral compensation should be displayed to the sport injuries which take place at schools. The compensation under the principle of fairness should be judged by the court while the schools may reject moral compensation. |
