| 摘 要： | 国有土地使用权出让的主体是国家,并由市、县人民政府土地管理部门代表国家行使国有土地使用权的出让权。但因土地使用权出让主体制度法律规范的不完善,导致在各级管理部门大量寻租行为的产生。本文针对这种现象,对土地使用权出让主体制度的立法现状、存在问题进行分析,提出了进一步完善的建议。

| Abstract: | It is the state of the main body system of the use right selling of the state-owned land,and the government land department has represented the state to make use of the use right selling of the state-owned land.But there is the flaw in the legal rules of the main body system the use right selling of the state-owned land,which has rusulted in a lot of corrupt actions on the government land department.The article analyses the current legislation and the existing problems of the main body system of the use right selling of the state-owned land,and offers some tentative plans. |
