| 摘 要： | 对国际体育仲裁院(CAS)裁决的异议可以上诉至瑞士联邦法院接受其司法审查,有关裁决如果符合《瑞士联邦国际私法》第192(2)条规定的条件之一就可能被撤销,即仲裁庭组成有问题,仲裁庭无权、越权或者拒绝管辖,仲裁侵犯当事人的平等和听证权,或者违反瑞士公共政策。但到目前为止瑞士联邦法院只撤销5例体育仲裁院裁决,其总体上的态度还是支持体育仲裁。

| Abstract: | The challenging of the arbitral awards made by the Court of Arbitration for Sports(CAS) can only be appealed to the Swiss Federal Court.The CAS awards can be attacked if the arbitral tribunal was constituted irregularly;if the arbitral tribunal erroneously held that it had or did not have jurisdiction;if the equality of the parties or their right to be heard in an adversarial proceeding was not respected;and if the award is incompatible with Swiss public policy.But up to now,there were only five cases that ... |
