| 摘 要： | 体育法在我国法律体系中的地位问题是体育法理论研究中的-个重大问题,也是一个存在许多争议的问题.明确体育法的地位,有助于我们认识体育法的本质、规律,有利于体育法体系自身的发展和完善.对比学术上对体育法地位问题的不同观点,分析法的体系划分的实质,探讨体育法的涵义及范畴.认为在目前的法律部门划分理论下,体育法并不构成独立的法律部门,应属社会法的范畴.

| Abstract: | The position of sports law in the law system is an important and controversial problem in the theoretical research.A definite position of sports law will not only help us to understand the essence and regulation of sports law,but also promote the improvement of this law system.By comparing different academic standpoints on the position of sports law,analyzing the substance of the divisions of law system,and examining the value and category of sports law.This article suggested that under current theories of the law department division,sports law,which is not an independent law section,should belong to the category of social law. |
