| 摘 要： | <体育法>总则是体育法中与其分则、附则相对应的,对于整个体育法具有统率作用的,规定体育法的立法目的、立法根据、法的原则等内容的条文总和.现行体育法总则在法的概念、法的效力、法的适用等方面有所缺失,需要进行法律漏洞补充,体育法应明确界定体育的概念,明确体育法的效力及适用范围;现行体育法在基本原则的设定上,政策宣言性强,指导性不够,我们应借鉴国外体育法的基本原则,考虑国情及社会发展实际,重新构建我国体育法的基本原则.故我国在设计体育法总则时,应遵循法的总则设置的基本思路,其内容应包括立法目的、立法根据、法的概念,法的效力、法的适用范围、体育主管部门以及体育法基本原则等.
