| 摘 要： | 目前我国体育仲裁的研究往往注重理论介绍与逻辑推演,并且大部分的研究都存在"制度迷信"的缺陷,抽空了中国的具体现实。在对这些研究进行反思的基础上,指出其贡献及其存在的问题,并在此基础上考量体育仲裁生成所需要的各种制度条件,得出中国体育仲裁的理想只有在国家竞技体育所处的政治经济条件发生积极变化时,符合中国具体国情的制度才有可能建立。
