| 摘 要： | 在反思已有研究不足的基础上,旨在通过对电竞合法性分析,为电竞可持续发展提供理论向导。电竞合法性的2个序阶:在语义学上要实现“名副其实”,在语用学上要实现“名正言顺”。当下电竞合法性辩护存在的问题:仅实现了在语义学上的逻辑自洽或理论圆融,缺乏逻辑与历史统一、理论与现实统一的分析;从应然性角度讲,电竞符合体育之规定,即具身性、科学性、自主性和伦理性,具有应然层面上的合法性;从实然性角度讲,在技术使用边界、技术规训、自我技术等方面具有不确定性,容易引发伦理风险。可见,电竞实践活动需要与日常生活中的道德文法结构相匹配,发展电竞要“合天道”,体现自然正当性;发展电竞要“合情理”,与民众生活观念相容,体现公众的普遍可期待性;发展电竞要“合法律”,法律是电竞产业运营的底线。建议,由于电竞主要面向未成年人,因技术不成熟而具有伦理风险,对此我们需要保持警惕。

| Abstract: | On the basis of reviewing the existing research,this paper tries to defend the legality of e-sports,in order to provide theoretical guidance for the sus tainable development of e-sports industry.There are two orders of the legitimacy of e-sports:in semantics,it should be"worthy of the name",and in pragmat ics,it should be"justified";The existing problems in the legal defense of e-sports:it only realizes the logical self-consistency or theoretical convergence in se mantics,but lacks the unification of logic and history,theory and reality at the level of pragmatics;From the perspective of ought to be:e-sports has legitimate of ought to be:embodied,scientific,independent and ethical;From the practical level,there is uncertainty in the use boundary of technology,self-technical disci pline and other aspects,which may easily lead to ethical risks.Research conclusion:the development of e-sports should be in harmony with heaven and reflect the natural legitimacy;the development of e-sports should be reasonable,should be compatible with the concept of public life,to meet the general expectations of the public;the development of e-sports should comply with the law,and the law is the bottom line of industrial operation.Finally,Suggestions are put forward:e-sports is mainly aimed at young people.Due to the immature technology,it has ethical risks,and we need to treat it with caution. |
