| 摘 要： | 首先分析了“体育专有技术”的涵义,然后研究了体育专有技术的法律性质和特点,认为体育专有技术是一种无形的财产权,也是一种特殊的知识产权,具有先进性和智慧性、秘密性、保密性、无期限性、无地域性、实用性和非专利性等特点。继而对体育专有技术的客体做了详细研究,指出了现行法律对体育专有技术的保护依据,最后提出完善现有立法、完善针对内部人员侵害体育专有技术的法律保护、规范转让行为、制定专有技术方面的专门法规和提高私力救济的意识和能力等加强体育专有技术法律保护的对策与建议。

| Abstract: | This article analyzed the meaning of peculiar technique in sports firstly, and then discussed its legal character and specialty. Peculiar technique in sport is a invisible property right, and also a special knowledge property right, it has some features including advance, intelligent, secret, no time limited and practical. In this paper, the authors explained its object in detail and pointed out the protecting foundation according to active national law. Lastly, this article proposed some countermeasures and suggestions on protecting the right of peculiar technique in sports. |
