| 摘 要： | 研究体育权利分类的技术目的在于寻找科学合理的划分标准.体育权利的性质、主体、客体、内容、发展阶段以及体育权利和国家的关系等等都可以成为体育权利分类的标准.从标准的多样性可以看出,对体育权利的划分是相对的.研究体育权利的分类不仅要在技术上完成对分类的考察,更重要的是要促成体育权利体系的完善.标准的设定可以凸显体育权利立法的缺陷和不足,体育权利的分类可以体现相关的体育立法理念.

| Abstract: | The purpose of studying the techniques for sports right classification is to seek for scientific and rational classification standards. The nature, subject, object and development stage of sports rights as well as the relation between sports rights and the nation and such can all become the standards for sports right classification. The essentials of the standards constitute the basic essentials for classifying the categories in the right system. It can be seen from the diversification of the standards that sports right classification is relative but not absolute. A once putative sports right will become an explicit legal right once it is confirmed by the law; a once declared sports right can be turned into a protected sports right as a result of times transition. In the study of sports right classification, we should not only finish our contemplation of classification technically, but also more importantly boost the perfection of the sports right classification system. Via standard establishment we can find defects and deficiencies of sports legislation of a nation, while via classification we can analyze the legislative conceptions applied to sports rights during sports legislation. |
