| 摘 要： | 随着电子商务的迅速发展，奥林匹克形象与价值在互联网上得以延伸，为了解奥林匹克域名的法律性质，预防奥林匹克形象与价值在互联网上受到伤害，对中国奥林匹克标志与域名的关系进行了比较。中国奥林匹克标志具有专门的法规和《商标法》去保护，而其域名保护仍主要采用域名争议解决机构去调解、仲裁。通过研究提出了加强相关立法、完善行政与司法救济等措施。

| Abstract: | As the rapid development of the electrical business,the image and value of Olympic games have been greatly extended in the websites.In order to make clear the legal nature of the Olympic web identity in China and prevent it from injuring in the web,by using the methods of documents collection and logic analyses,this article investigated the relation between the mark and the Olympic web identity.The results showed that China had got special statues and commercial laws to protect the Olympic marks, while there were no laws to protect its web identity at present,so we have to depend on some correlative organizations to mediate and intercede the problems.Some measures are proposed to reinforce the laws-making,administration-consummating and judicatory almsgiving. |
