| 摘 要： | 从法律法规角度出发，结合学校体育的具体实践，分析探讨了学校体育中未成年学生伤害事故的归责。结果表明：学校不是未成年学生任何形式的监护人；未成年学生发生伤害事故的法律责任主体是学校、教师、监护人和其它组织或个人；要进一步加强立法，完善伤害事故保险及基金制度和更新教育观念。

| Abstract: | On the legal liability viewpoint combining school PE theory with practice in causing injures among under age students the paper probes into the legal hiability of students ining in the school PE.To conclusions: school is not guardian of under age student ; The subject of liability includes school, teacher, student, other organization and individual ; It is important to enhance legislation power and found insurance system for unexpected injury and renewal of education idea. |
