| 摘 要： | 我国体育法学研究尚缺乏学派意识和学术批判意识,关于体育法理学和法律方法论的研究逐渐边缘化,体育法学学科建设缺少基础法学理论的支撑。近年来,法教义学在法学领域逐渐占据了一席之地,与社科法学形成了分庭抗礼的趋势。通过对法教义学的内涵、立场与方法论的分析,从体育纠纷解决机制的构建、体育司法裁判的"同案同判"以及体育法法源明确的角度,探索在法教义学信奉的司法中心主义指导下我国体育法治建设与发展的路径,并将法教义学的概念引入体育法学视野。

| Abstract: | The study of sports jurisprudence in China lacks the consciousness of school and academic criticism. The research on sports jurisprudence and legal methodology is gradually marginalized. The construction of sports jurisprudence lacks the support of basic legal theory. In recent years, legal dogmatics has gradually occupied a place in the field of law, and it has formed a trend of court resistance against social science law. In this article, through the analysis of the connotation, standpoint, and methodology of legal dogmatics, from the perspectives of the establishment of a sports dispute resolution mechanism, the "same case, same judgment" of sports judicial referees, and the clear source of sports law, the authors explores the belief in legal dogmatics under the guidance of judicial centralism, the path of construction and development of sports law in China. Meanwhile, the concept of legal dogmatics is introduced into the field of sports law. |
