| 摘 要： | 运用文献资料法、比较法等方法,对日本《体育基本法》的立法情况和立法内容进行了深入研究,并分析其对中国《体育法》修改的可借鉴之处。研究认为,我国《体育法》应该对体育进行较高的价值定位,并界定清楚所调整的"体育"的概念和含义。《体育法》修改应确认公民体育权利,并要以公民体育权利保护为立法理念的核心,促进全民体育的发展。还应明确法定体育管理体系,确定各级体育行政部门、体育社会组织的权责与义务,增加对基层体育机构和组织建设的立法内容。要考虑到配套法律和政策的可操作性和可执行性,使《体育法》及其配套法律和政策能够为新时代体育事业的发展作出应有贡献。

| Abstract: | The article uses the method of literature and comparative and explore the legislation and content of the Basic Law of sports in Japan.The research shows that the Sports Law in China should carry on the higher value orientation to China′s sports,and define clearly the concept and meaning of adjusted"sports".The amendment of the Sports Law should confirm the citizens′sport rights,and take the protection of citizens′sports rights as the core of legislation concept and promote the development of sports for all.the Sports Law should regulate sports management system,increase the legislative provisions for the construction of grassroots sports institutions and organizations,and also consider the operability and enforceability of supporting laws and policies.Only in this way can they make due contributions to the development of sports in the new era. |
